Photography Tours: Terms and Conditions

Covid-19 and Our Terms and Conditions and Cancellation Policy (Updated 21 October 2021)

If you have booked a tour with us, or are thinking about booking a tour with us, and you’re concerned about the impact of Covid-19 (Novel Coronavirus) on your travel, please read the following.

In the scheduling and running of our photography tours, we follow guidelines from the Government, airlines and our tour suppliers. Your decision to travel is a personal one and the decision you make must be based on your personal circumstances and the information available to you in regards to the impact of Covid-19 on travel. It’s important to make sure that your information comes from a reputable source including the World Health Organisation, Smartraveller and the Australian Department of Health (or relevant website from your own country).

Cancellation policy if you decide not to travel after booking a tour with us

If you decide to cancel your travel with us because of concerns about Covid-19, you will be subject to the Terms and Conditions (see below) you agreed upon when you made your booking and paid your deposit and/or balance for the tour.

This may result in cancellation fees and forfeiture of a proportion or all of the fees paid, including your deposit. See below to determine the extent of your liability.

You should also consult your travel insurer and their PDS in order to determine if you will receive any compensation for cancelling the tour and/or whether you will be covered if you fall sick while on tour.

What if the tour cannot run because of Covid-19 imposed travel restrictions?

In the case of Covid-19 travel restrictions being imposed, our Limitations of Liability in the event of Force Majeure applies (see Terms and Conditions below). In summary, should travel restrictions or snap lockdowns prevent Venture Photography from delivering all or part of the photography tour, we will refund the customer for the uncompleted part of the tour less any reasonable losses incurred before cancellation. Venture Photography will use reasonable endeavours to minimise losses incurred by customers.

Note: Any offers of a partial refund or credit note (to be used at a later time), is at the absolute discretion of Venture Photography. We reserve the right to withhold some monies to cover administrative expenses and other losses, dependent on when notice of cancellation is given by the customer.


Photography Tours Terms and Conditions

You must be at least 18 years old and have the authority to accept on your behalf our terms and conditions.

If you are making a booking on behalf of other persons, you must be authorised to make the booking on behalf of all of the members of the party. The person making the booking must also provide a copy of these terms and conditions to the other members of the party. Please read the terms and conditions carefully. They apply to all members of your party.

Our confirmation/invoice is acceptance of your booking and confirmation of the travel contract between you and Venture Photography Workshops. Please let us know if any details in the confirmation document are incorrect within 48 hours of your booking and payment of the deposit, otherwise the details shown in the confirmation document will be presumed to be correct.

Confirmation of your booking is made upon our acceptance of the deposit. The date for settlement and final payment will be identified in the confirmation document/invoice. If settlement is not paid by the deadline, your booking is cancelled and the deposit retained.

For bookings made within 60 days of the tour start date, full settlement is requested upon your booking.

We reserve the right to increase or reduce the tour price, so the current price of this tour will be advised to you at the time of booking. While every effort is made to provide reliable information and display correct prices on our website, unfortunately errors do occasionally occur. In the event that an incorrect price has been entered in error, any booking made with this price will not be valid. You will be advised of the mistake at the earliest opportunity and you will have the option either to pay the correct price for the booked package or to cancel and receive a full refund of any amount you have already paid (see “Cancellations and Refunds” below).

Cancellations and Refunds

If you have to cancel your booking, you may have to pay a cancellation charge. Cancellations must be made in writing or by email by the person who made the original booking and paid the deposit.

You may cancel without penalty if:

  • The tour package price increase exceeds 10% as a consequences of changes made after the price is first advertised.
  • A major change occurs to the tour itinerary and programme, such as a significant change in the dates of the tour, the number of days of the tour, or major changes to the destinations and locations listed in the itinerary. Note that changes in tour accommodation, tour dates changing within a range of 1-3 days, and minor changes to the programmed activities are not regarded as major changes.

The following cancellation charges apply:

  • Deposits are non-refundable. The only exception to this is if the tour is cancelled by the organisers at least 60 days before the tour date because it has not attained minimum numbers of guests in order to run, in which case deposits are fully refunded.
  • If you cancel within 59 and 41 days before departure: 50% of settlement is charged as the cancellation fee.
  • If you cancel within 40 and 35 days before departure: 75% of settlement is charged as the cancellation fee.
  • If you cancel less than 35 days before departure: 100% of settlement charged as the cancellation fee (ie. no refund).

The date we work out your cancellation charge amount is the date we receive written notice of your cancellation at our office. You will receive a cancellation invoice upon your request to cancel.

Limitation of Liability

Should the tour itinerary or its features/highlights change, or the tour be cancelled due to circumstances outside of Venture Photography’s control control (including but not limited to war, threat of war, riots, terrorist activities, civil disturbances, industrial disputes, serious illness, natural and nuclear disasters, adverse weather conditions, hurricanes, floods, unavoidable technical issues with transport, epidemic, pandemic and similar), the organiser will hold not liability towards travellers. No compensations, payments, expenses or any sums, including the cost of securing alternative accommodation or flights will be paid by the organiser.

In the event of a force majeure event making it impossible or unsafe for Venture Photography to deliver all or part of the tour, we may, at our discretion, refund the customer for the uncompleted part of the tour less any reasonable losses incurred before cancellation. In some cases, losses may amount to a substantial proportion of the booking price. Venture Photography will use reasonable endeavours to minimise losses incurred by customers.

Health Requirements

Our tours are designed for adults of all ages who are in good to reasonable health and of moderate level of fitness. Some activities on tour may require walking and hiking for distances of up to 1 to 5 kilometres trails and short inclines and descents. These activities will be identified in the detailed itinerary of the tour. Guests may choose to opt out of such activities at their own discretion.

You will need to be able to carry your own camera equipment and water during this tour.

Vaccinations may be required for some tours. You are responsible for the cost of these vaccinations and will need to show proof of vaccinations to the tour organiser prior to the start date of the tour.

You will need to disclose any medical or physical conditions that you have, which may create a risk to you or to other tour participants. The organiser assumes no responsibility for your medical care nor guarantee to meet your special dietary requirements.

You may only participate on this tour on provision of your obtaining comprehensive travel insurance for the duration covered by the dates of the tour, inclusive of departure and arrival dates.

Indemnity

When you book to join one of our tours, you accept responsibility for the proper conduct of yourself and your party during your stay. We reserve the right at any time to terminate (before or after departure) your holiday or that of any member of your party due to your or their misconduct. Full cancellation charges will then apply and no refund will be given. Furthermore, we shall be under no obligation whatsoever to pay compensation or meet any costs or expenses you may incur as a result of the booking being terminated in accordance with this paragraph. If your actions or those of your party cause damage to the accommodation or transport you are using, you agree to fully indemnify us against any claim (including legal costs) made by the accommodation or transfer provider. You are also liable to make reimbursement to the accommodation or transfer provider for any damage caused, before you end your stay.

Your Privacy

We will not share with any third parties your personal data (such as your name, contact details, travel preferences and any special needs/disabilities or dietary requirements) and will use them for the operational needs related to your purchased tour package. We may also use your email or postal address to send you information and brochures related to our activity; should you wish to not receive these, please inform us upon booking.
